1. ผู้ให้บริการและการยอมรับข้อกำหนด

AIYA (AiPage) ("บริการ") ให้บริการโดย บริษัท มีจีเนียส จำกัด ("เรา") การเข้าใช้งานหรือเชื่อมต่อเพจ Facebook ถือว่าท่านยอมรับข้อกำหนดนี้ หากท่านใช้แทนองค์กร ท่านยืนยันว่ามีอำนาจผูกพันองค์กรนั้น

2. บริการที่ให้

บริการช่วยจัดการเพจ Facebook ที่ท่านเป็นผู้ดูแล ได้แก่ เชื่อมต่อเพจ สร้างและตั้งเวลาโพสต์ อ่านและตอบข้อความ Messenger อ่านและตอบคอมเมนต์ (รวมการตอบกลับอัตโนมัติด้วย AI ทั้งแบบสาธารณะและข้อความส่วนตัว) และดูสถิติของเพจ

3. ข้อมูลจาก Meta

เราเข้าถึงข้อมูลของเพจและข้อความ/คอมเมนต์ของผู้ติดต่อเท่าที่จำเป็นต่อบริการ ผ่านสิทธิ์ที่ท่านอนุญาตใน Facebook Login เราใช้ข้อมูลนี้เพื่อให้บริการแก่ท่านเท่านั้น ไม่ขายข้อมูล และจัดการตามนโยบายความเป็นส่วนตัวของเรา ท่านเพิกถอนสิทธิ์ได้ตลอดเวลาที่ Facebook (การตั้งค่า > แอปและเว็บไซต์) การใช้บริการต้องเป็นไปตามข้อกำหนดแพลตฟอร์มของ Meta ด้วย

4. หน้าที่ของท่าน

ท่านรับผิดชอบเนื้อหาที่โพสต์และข้อความที่ตอบ รวมถึงข้อความที่บอทตอบแทนท่าน ท่านต้องมีสิทธิ์จัดการเพจ ได้รับความยินยอมจากลูกค้าตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล และตรวจสอบการตั้งค่าตอบอัตโนมัติของท่านเอง

5. การใช้งานที่ห้าม

ห้ามส่งสแปมหรือข้อความที่ผิดกฎหมาย หลอกลวง ละเมิดสิทธิผู้อื่น ห้ามใช้บริการฝ่าฝืนนโยบายของ Meta ห้ามพยายามเข้าถึงระบบหรือข้อมูลที่ไม่ได้รับอนุญาต เราระงับหรือยุติบริการได้หากพบการละเมิด

6. เนื้อหาที่สร้างด้วย AI

ข้อความและรูปที่สร้างด้วย AI อาจคลาดเคลื่อน ท่านควรตรวจก่อนเผยแพร่หรือเปิดใช้ตอบอัตโนมัติ เรามิได้รับประกันความถูกต้อง

7. ค่าบริการและเครดิต

แพ็กเกจ ราคา และเครดิต AI เป็นไปตามที่แจ้งในหน้าราคา ณ เวลาสมัคร เครดิต AI ที่ใช้ไปแล้วไม่สามารถขอคืนเงินได้ เว้นแต่กฎหมายกำหนด

8. การสนับสนุนและการจำกัดความรับผิด

ชั่วโมงให้บริการและเป้าหมายเวลาตอบรับสำหรับลูกค้ารายใดอาจกำหนดไว้ในสัญญาบริการหรือ SLA ที่ลงนามแยกต่างหาก หากมีสัญญาดังกล่าว ให้ใช้สัญญานั้นเป็นหลักสำหรับลูกค้ารายนั้น หากไม่มี เราให้การสนับสนุนอย่างเต็มกำลัง (best-effort) ในเวลาทำการของบริษัท การจำกัดความรับผิดทั่วไปตามด้านล่างแยกต่างหากจากข้อนี้

การหยุดชะงักและการเปลี่ยนแปลงบริการ เราอาจระงับบริการชั่วคราวเพื่อบำรุงรักษา เมื่อระบบขัดข้อง หรือเมื่อเกิดเหตุสุดวิสัย และอาจปรับเปลี่ยนหรือเลิกบริการบางส่วน เราไม่รับผิดชอบต่อการระงับชั่วคราวหรือการเปลี่ยนแปลงเหล่านี้ ทั้งนี้ ท่านยังขอลบข้อมูลของท่านได้ตามข้อ 9

ไม่มีการรับประกัน บริการให้ตามสภาพที่เป็นอยู่ เราไม่รับประกันว่าบริการปราศจากข้อบกพร่อง ข้อผิดพลาด หรือเหมาะกับวัตถุประสงค์เฉพาะของท่าน และไม่รับประกันการทำงานของ Meta ซึ่งอยู่นอกการควบคุมของเรา

ขอบเขตความรับผิด เรารับผิดต่อความเสียหายโดยตรงที่เกิดจากการใช้บริการเท่านั้น และไม่เกินค่าบริการที่ท่านชำระจริงในเดือนที่ความเสียหายเกิดขึ้น เราไม่รับผิดต่อความเสียหายทางอ้อมหรือการสูญเสียกำไร การจำกัดและยกเว้นความรับผิดนี้ไม่ใช้กับความเสียหายที่เกิดจากการกระทำโดยเจตนาหรือความประมาทเลินเล่ออย่างร้ายแรงของเรา และไม่กระทบสิทธิของท่านที่กฎหมายไม่อนุญาตให้ยกเว้น

9. การยกเลิกและการลบข้อมูล

ท่านเลิกใช้ได้ทุกเมื่อโดยตัดการเชื่อมต่อเพจหรือแจ้งปิดบัญชี การลบข้อมูลดู การลบข้อมูล

10. การเปลี่ยนแปลง กฎหมายที่ใช้ และติดต่อ

เราอาจแก้ไขข้อกำหนดและจะแจ้งในหน้านี้ ข้อกำหนดนี้อยู่ภายใต้กฎหมายไทย ศาลในกรุงเทพมหานครมีเขตอำนาจ ติดต่อ: LINE OA @aiyaclub, อีเมล dpo@aiya.ai

1. Provider and acceptance

AIYA (AiPage) (the "Service") is provided by MeGenius Company Limited ("MeGenius Co., Ltd."; บริษัท มีจีเนียส จำกัด) ("we"). By signing in or connecting a Facebook Page you accept these terms. If you act for an organization you confirm you can bind it.

2. What the Service does

It helps you manage Facebook Pages you administer: connect a Page, create and schedule posts, read and answer Messenger messages, read and answer comments (including AI auto-replies, public and private), and view Page statistics.

3. Data from Meta

We access Page data and contacts' messages and comments only as needed for the Service, through the permissions you grant in Facebook Login. We use it only to serve you, we do not sell it, and we handle it under our Privacy Policy. You can revoke access at any time in Facebook (Settings > Apps and Websites). Use of the Service must also comply with Meta's platform terms.

4. Your responsibilities

You are responsible for content you publish and replies sent, including replies a bot sends for you. You must be authorized to manage the Page, have any consent required under data protection law, and review your own auto-reply settings.

5. Acceptable use

No spam, unlawful, deceptive or rights-infringing content; no use that breaches Meta policies; no attempt to access systems or data without authorization. We may suspend or end the Service for violations.

6. AI-generated content

AI-generated text and images may be inaccurate. Review before publishing or enabling auto-replies. We do not warrant accuracy.

7. Fees and credits

Plans, prices and AI credits are as shown on the pricing page at signup. AI credits that have been used are not refundable, except as required by law.

8. Support and limitation of liability

Support hours and response targets for a particular customer may be set in a separately signed service agreement or SLA; where one exists, it prevails for that customer. Otherwise, support is provided on a best-effort basis during business hours. The general limitation of liability below is separate from this clause.

Interruptions and changes. We may suspend the Service temporarily for maintenance, outages or force majeure, and may change or discontinue parts of it. We are not responsible for such temporary suspensions or changes. You can still ask for your data to be deleted as described in section 9.

No warranty. The Service is provided "as is". We do not warrant that it is free of defects or errors or fit for your particular purpose, or the behavior of Meta, which is outside our control.

Scope of liability. We are liable only for direct damage caused by use of the Service, and not beyond the fees you actually paid in the month the damage occurred. We are not liable for indirect damages or lost profits. This limit and exclusion do not apply to damage caused by our willful misconduct or gross negligence, and do not affect rights that cannot be excluded by law.

9. Termination and data deletion

You may stop at any time by disconnecting your Page or asking us to close your account. For deletion see Data deletion

10. Changes, governing law, contact
